Context & Mission

M\\xc3\\xa9decins Sans Fronti\\xc3\\xa8res (MSF) is an international medical humanitarian organization founded in 1971 that provides impartial humanitarian assistance in more than 70 countries to populations in distress, victims of natural or manmade disasters and to victims of armed conflicts, without discrimination and irrespective of religion, creed or political affiliation.

OCG\\xe2\\x80\\x99s legal team is under the hierarchical supervision of OCG General Direction and OCG Director of Operations, and under the functional supervision of the Director of the Intersectional Legal Department (ILD).

Acting as a member of the ILD, the Flying Legal Advisor works in an integrated way with other legal advisors to ensure that MSF receives qualitative and harmonised support, whilst capitalizing specialized legal expertise and experience. Under the technical supervision of ILD Unit 2 Manager, the Flying legal advisor is responsible to provide direct legal support to operations via field visits, with regards the medico-legal questions related to MSF activities.

Tasks and Responsibilities

Legal Support to field missions for medico-legal matters and MSF responsibilities towards patients
  • Provide analysis of the legal framework applicable to MSF medical and humanitarian activities for relevant contexts;
  • Monitor legal and regulatory developments concerning the medico-legal issues applicable to MSF\\\'s medical and humanitarian activities;
  • Provide legal advice to operations on the following issues:
  • Disclosure of medical information to third parties and protection of medical confidentiality,
  • Patient consent/assent,
  • Medical certification,
  • Sexual and reproductive rights,
  • Specific policies applicable to minors,
  • Requests of arrest/detention/interrogation of patients,
  • Management of individual/specific protection cases;
  • MSF\\\'s collaboration with national/international investigative mechanisms/courts and (non-) judicial investigative bodies.
  • Carry out frequent field visits to provide support to field teams. Field visits to be defined as per operational needs and in agreement with Operations Direction and Unit 2 Intersectional Manager;
  • Support field teams in the prevention and management of legal risks arising from medico legal issues;
  • Ensure the dissemination of the Medico Legal Toolbox among field teams;
  • Brief and train field teams on issues pertaining to the protection of MSF\\xe2\\x80\\x99s medical mission and medico-legal policies/tools/guidelines;
  • Contribute to the definition and follow up of the implementation of archiving system of (highly sensitive) data;
  • Ensure specific implementation of MSF policies on the certification for survivors of violence;
  • Develop tools and draft guidelines and memos on medico-legal matters to support the field teams.
Participation in the ILD
  • Fill out the activity report of the ILD (Case.one)
  • Active member of the intersectional working groups & ILD days
  • Provide inputs for the development and implementation of new guidelines, templates, policies.
Your Profile

Education
  • An advanced university degree in law (Master\\xe2\\x80\\x99s degree or equivalent) - compulsory.
  • A focus on Human Rights, Humanitarian Action, international Humanitarian Law or Public Health/medical ethics - an asset
Experience
  • Minimum 3 years of professional experience as legal advisor
  • Field experience in MSF required
  • Experience with other humanitarian organizations is an asset
Languages
  • Fluency in English and French compulsory (oral and written)
  • Fluency in another language is an asset (Spanish, Arabic, etc.).

Terms of Employment
  • Fixed-term contract, 12 months
  • Full-time, 100% (40h/week)
  • Working place : Field-based position with visits to the headquarters in Geneva
  • Practical working conditions in the field are in accordance with the MSF OCG volunteer manual.
  • Ideal start date: Early January 2024
  • Gross monthly salary: CHF 5\\xe2\\x80\\x99500.- based on 100%
  • Benefits: Health insurance and living expenses in the countries of intervention and at headquarters, paid according to internal regulations.
